This agreement is an official offer by Individual Entrepreneur Eva Arturovna Widenmeer for individuals to enter into an Agreement for the provision of services for organizing and conducting retreats, in accordance with the conditions established in this Offer.
This public offer for the provision of services (hereinafter referred to as the agreement) is concluded in a special manner: by accepting this agreement, which contains all the essential terms of the agreement, without signing by the parties. This agreement has legal force in accordance with Art. 434 of the Civil Code of the Russian Federation and is equivalent to an agreement signed by the parties.
This agreement is a contract of adhesion. The fact confirming the acceptance of the conditions set out below and the acceptance of this public offer is the order of services (in accordance with paragraph 3 of Article 438 of the Civil Code of the Russian Federation, acceptance of the offer is tantamount to concluding an agreement on the terms set out in the offer). The person who ordered the service is recognized as the Client or the Client’s representative with the appropriate authority.
1. Terms used
Organizer – Individual entrepreneur Eva Arturovna Widenmeer and her authorized representatives.
Services – the Organizer’s services for organizing and conducting a retreat in accordance with the terms of the Offer.
Retreat participant (participant) is an individual who receives access to the Services under this agreement.
The Website is the Organizer’s information resource on the Internet, located at https://retreat-svm.com, which contains information about the conditions of the Retreat, including the Retreat schedule and the rules for the Retreat. The Website is a platform through which the Service can be directly ordered. The information on the site can be changed or supplemented at any time.
Order - a Participant’s request to receive services for organizing a retreat under the conditions selected on the Site.
Retreat is a set of events organized by the Organizer under this Agreement, including accommodation, as well as other events provided for by the Retreat schedule.
Master – leading Retreat spiritual mentor.
Event – an event provided for in the Retreat schedule.
Intended payment – funds transferred by the Retreat Participant before the provision of services, which is confirmation of full and unconditional acceptance of this public Offer.
Gratitude – payment, money contributed for participation in the Retreat.
2. General provisions
The Retreat Participant hereby presumes and confirms that he has sufficient right and legal capacity (legal personality, tortious capacity) sufficient to conclude an Agreement with the Organizer for the provision of services for organizing and conducting away retreats under the conditions established in this Offer and chosen by the Participant.
The subject of this Agreement is the organization and conduct of the Retreat by the Organizer (hereinafter referred to as the Services). The location of the retreat, the convenience of accommodation, as well as other conditions (including the amount of gratitude) provided for the Participant of the corresponding retreat are posted on the website https://retreat-svm.com and are updated for each retreat. The participant confirms acceptance of the terms of the Retreat by making an intentional payment before directly participating in the Retreat. The topic, program, duration of the Services, registration form and other significant information about the Service are published on the website https://retreat-svm.com.
3. Rights and obligations of the parties
3.1. The organizer is obliged:
3.1.1. Provide the Participant with the opportunity to participate in accordance with the conditions of the retreat posted on the website https://retreat-svm.com.
3.2. The organizer has the right:
3.2.1. Change the terms of this Offer by publishing changes on the website, which come into force from the moment of publication.
3.2.2. Place the Organizer’s corporate logo, as well as reviews from Participants about the quality of the Organizer’s Services on the website and in your advertising materials to demonstrate the fact of cooperation with the Organizer and the quality of the Services provided.
3.3. The Retreat participant must:
3.3.1. Make an intentional payment in the amount and within the time limits provided for in section 5 of this Offer.
3.3.2. Provide reliable data, including personal data of the Participant when registering on the Organizer’s website and reliable data, including personal data, of the Participant when preparing payment documents when effecting payment.
3.3.3. Follow the schedule of the Retreat, observe discipline, generally accepted standards of behavior when attending scheduled events of the Retreat, show respect for the Organizer’s staff and other Participants, do not infringe on their honor and dignity, do not miss events without good reason, do not be late for events, follow the recommendations of the Master and authorized representatives.
3.3.4. Do not allow aggressive behavior during the provision of services, do not interfere with the Organizer’s representative or other Participants when providing/receiving Services, do not allow statements (orally, in writing) that are not related to the topic of the Retreat.
3.3.5. During events, turn off any sound devices the Participant has.
3.3.6. Do not use information received from the Organizer in ways that could lead or will lead to damage to the interests and reputation of the Organizer, its authorized representatives or the Master.
3.3.7. Do not use the materials provided by the Organizer for the purpose of making a profit by duplicating them and reproducing them multiple times (publications in the press and other publications, public speaking, etc.) and in other ways.
3.3.8. Notify the Organizer if you miss a class for a valid reason before the start of the class.
3.3.9. Do not assign your rights under the contract to third parties without the consent of the Organizer.
3.3.10. Do not damage property and premises at the Retreat location and do not take any actions that could harm the business reputation of the Organizer.
3.3.11. Do not smoke during the entire Retreat, do not appear at classes showing signs of/in a state of alcohol, drug or other intoxication and do not consume alcohol and drugs on the territory of the Retreat and/or during the provision of Services, do not use profanity, do not use in communication expressions that may offend a representative of the Organizer or other Participants, do not distribute advertising or offer the services of third-party resources, your services or the services of third parties.
3.3.12. In case of missing an event/events of the Retreat, for reasons beyond the control of the Organizer, the Participant has no right to demand that the event be repeated, the Participant be enrolled in the next Retreat, or the information contained at the event be brought to his attention in a different form. In this case, the services are considered to be properly provided by the Organizer.
3.3.13. Follow the Retreat rules published on the Organizer’s website. Compliance with the rules of the Retreat is a condition of participation in it. If the Participant violates the rules of the Retreat, the Organizer has the right to remove the Participant from the Retreat. In case of removal, the Participant is prohibited from continuing the Retreat, but the services are considered to be provided in full and properly. Since the Retreat regime may differ from the Participant’s usual regime (day, nutrition, activities, etc.), it is recommended to consult with a specialist before deciding to Participate in the Retreat. The Participant is informed that the Organizer is not responsible for the health status of the Retreat Participant and does not provide medical services.
3.3.14. During the Retreat, do not use mobile phones and other gadgets that interfere with compliance with the rules of the Retreat. If the Participant wishes, the mobile device can be handed over to the Organizer at the beginning of the Retreat. You can listen to music recommended by the Master using headphones.
3.4. The organizer does not guarantee the effectiveness, practical applicability and value of the information obtained during participation in the classes; fulfillment of any forecasts and predictions, and is not responsible for their failure to fulfill or the consequences of their fulfillment.
3.5. The Organizer is not responsible for the compliance of the content of the Retreat events with the Participant’s expectations.
3.6. The Organizer is not responsible for the consequences of decisions made by the Participant based on information received during the Retreat.
3.7. The organizer is not responsible for other people who conduct consultations and training events based on his information.
3.8. Only Retreat Participants may be on the Retreat territory. The presence of other persons is not allowed without the consent of the Organizer.
3.8.1. Minor children of Retreat participants may be on the Retreat territory under full responsibility and under the constant uninterrupted supervision of their parents.
3.8.2. The parent is obliged to inform the Organizer about the participation of minor children in advance, when submitting an application for participation in the Retreat.
4. Procedure for concluding an agreement. Acceptance.
4.1. The Participant agrees to the Agreement automatically by leaving a request through the website and receiving a booking confirmation from the Organizer.
4.2. By accepting this offer, the Participant agrees with all the terms and conditions set out in it.
5. Gratitude and payment procedure
5.1. Information on the amount of gratitude for participation in the Retreat is published on the Organizer’s website https://retreat-svm.com.
5.2. The participant makes the intended payment within 3 (three) days from the date of receipt from the Organizer of confirmation of registration for the Retreat and a link to make the intended payment. The Participant pays the remaining amount on the day of the start of participation in the Retreat.
5.3. An intentional payment in the amount of 15,000 (fifteen thousand) rubles 00 kopecks is made by the Participant by transferring funds to the Organizer’s bank account via a link received from the Organizer, or through a chat bot in Telegram.
5.4. The date of payment of gratitude is considered to be the date of receipt of funds to the Organizer’s bank account.
5.5. The intentional payment is the Participant’s confirmation of his intention to take part in the retreat, confirms his familiarization with and agreement to the Rules for participation in the Retreat; the intentional payment is not refundable. The parties agreed that the amount of the intended payment corresponds to the expenses the Organizer incurred to organize the processing of the Participant’s Application.
5.6. At the request of the Participant, gratitude can be paid at a time in the amount of 100%.
5.7. A participant who has not provided gratitude on the day the Retreat begins will not be allowed to attend the Retreat, and the intended payment will not be returned.
5.8. The parties agreed that in the event of termination of the Participant’s participation in the Retreat before its end, or non-participation in the Retreat after making the intended payment, for reasons not related to the Organizer’s failure to fulfill or improperly fulfill the terms of the Offer, the Organizer’s obligations are considered fulfilled in full and properly. In this case, gratitude or intentional payment made will not be returned.
6. Validity period of the Offer
6.1. The offer agreement comes into force from the moment it is posted on the Internet at https://retreat-svm.com and is valid until the Offer is withdrawn by the Organizer.
6.2. The Participant agrees and acknowledges that making changes to the Offer entails making these changes to the Agreement concluded and valid between the Participant and the Organizer, and these changes to the Agreement come into force simultaneously with such changes to the Offer.
6.3. Without conflicting with the terms of the Offer, the Organizer and the Participant have the right at any time to draw up an Agreement for the provision of services in the form of a written bilateral document.
7. Responsibility of the parties
7.1. For failure to fulfill or improper fulfillment of obligations under this Offer, the Parties are liable in accordance with the legislation of the Russian Federation.
7.2. The parties are released from liability for non-fulfillment or improper fulfillment of the terms of this offer in the event of the occurrence of force majeure circumstances (force majeure), determined in accordance with the current legislation of the Russian Federation, if they present evidence that these circumstances prevented the fulfillment of obligations under this Offer, such evidence is provided by documents from the competent authorities of the Russian Federation. From the moment the force majeure circumstances are eliminated, the Offer is valid as usual.
7.3. The Organizer is not responsible for the consequences resulting from the use of information obtained as a result of the provision of Services under this Offer.
7.4. If the Participant violates any of the obligations provided for in this Offer, the Organizer has the right to refuse to provide the Service. The Participant agrees that in this case the money paid is not returned and is a penalty collected from the Participant in favor of the Organizer.
8. Other conditions
8.1. The information received by the Participant during the provision of the Service is the intellectual property of the Organizer and is subject to protection in accordance with the legislation of the Russian Federation. Distribution of the received information or transfer to any third parties is not permitted.
8.2. The participant fully understands and accepts that he acquires the right to participate in the Retreat, at which all events are audio and video recorded, as well as broadcast live via the Internet. The Participant acknowledges and agrees that any joint photos and videos with the Master are the property of the Master, and the right to dispose of them belongs exclusively to the Master.
8.3. If disputes and disagreements arise, the Parties undertake to make every possible effort to resolve them through negotiations. The period for responding to a claim is set at 10 (ten) calendar days.
8.4. Disputes and disagreements on which the Parties have not reached an agreement shall be resolved in accordance with current Russian legislation.
8.5. By accepting the terms of this Offer, the Participant expresses his consent to receive information by email to the User about all events held by the Organizer, the conditions for their implementation, financial conditions and other information, regardless of the validity period of this Offer. In this case, the Participant has the right to refuse the mailing list at any time.
